Non-Muslims Decline Invitation to Have Tea in Shariah Parlour

PAS and UMNO politicians are quick to reprimand non-Muslims for refusing to support their proposal to amend Act 355, despite being given assurances that the Act will not affect non-Muslims. These politicians ignore the fact that non-Muslims have good reasons to be wary of enhanced shariah courts since their freedom has been violated many times by Shariah officials. Non-Muslims are eminently reasonable when they argue they should have a genuine say in drafting laws that impact their lives, and that it is the civil court rather than the shariah court that should be enhanced since only the civil court can provide a fair and natural platform to ensure equal protection under the law for citizens from diverse religions seeking to forge a common life in a plural society.
Non-Muslims remain wary of Muslim legislators who have demonstrated that they are prepared to act unilaterally as they press ahead with Shariah-complaint laws with a view of imposing them on non-Muslims. Given below are two further examples of disturbing rhetoric from Muslim legislators who insist that Shariah law should be applied to non-Muslims. This rhetoric can only heighten the anxieties of non-Muslims.
Note that the proposed law to abolish black magic will be applied to non-Muslims. More disturbing is the proposal that the special body of Islamic experts advising (supervising?) the court are exempted from cross examination, and that its judgment in a trial will be accepted by the court as conclusive.
I. SPECIAL LAW TO ABOLISH BLACK MAGIC

BLACK MAGIC is a form of magic pioneered by the Devil to humans who intend to bring harm either the practitioner himself or his victim.
Realizing the importance of this issue, the Association of Muslim Lawyers Malaysia (PMM) in collaboration with the Club of Young Lawyers Malaysia Egypt (CAR) recently organized a seminar in Egypt. The seminar was entitled, ‘Diagnosis of Magic: Where will it end’.
The seminar becomes more significant with the presence of several Shariah Court judges Datuk Abdul Walid Abu Hassan (Chief Judge of Penang), Datuk Abdul Rahman Md. Yunus (Chief Judge of Pahang) and Muhammad Azhari Abd. Rahman (Pahang Syariah High Court Judge).
THE NEED TO CREATE LAWS TO ABOLISH BLACK MAGIC
Laws which abolish the practice of black magic should be established, not just from the perspective of criminal law only; these laws should apply to other laws, whether civil or shariah.
This is because black magic happens in family affairs, business and friendship. Black magic involves not only Muslims as many non-Muslims also practise it.
Therefore, if the matter of this magic is placed only within the purview of shariah courts, then it will be the case that key aspects of this legislation that is introduced will not be achieved because non-Muslims will be exempted from the jurisdiction of these law. These laws should be extended to include the shariah and civil courts so that justice is equally applied to non-Muslims.
However, I think main problem is the question of proving that someone is guilty of practising black magic. This is because the magic involves using a spirit which cannot be seen by the naked eye…
BEST ALTERNATIVE
The authorities need to set up a special body comprising a group of experts who have high credibility, including those members of the ulama. They need to be screened and confirmed to have real expertise in the related field. The panel will be given the responsibility of validating these matters of black magic and its effects.
The declaration by this special body, along with the basis of its judgment should be brought to court and accepted by the court as conclusive evidence. In this way, the experts are not cross-examined in court and are not subject to the troublesome procedures of proof in court. In this way, they will be able to assist the court in making the right decision.
It is recommended that the Attorney General should establish a special committee comprising members of the ulama and experts in Islamic law who are proficient in the fight against black magic. They will be joined by experts in modern and Islamic medicine and legislators to draft the relevant laws.

II. Action can be Taken Against Anyone Belittling a Fatwa

PETALING JAYA: Action can be taken against anyone belittling an edict (fatwa) prohibiting Muslims from participating in beauty pageants, says Federal Territory syarie chief prosecutor Ibrahim Deris. He added that even non-Muslims would not be spared because such behaviour would be deemed as insulting Islam.
“For Muslim offenders, we will take action under the syariah criminal offences. For non-Muslims belittling the edict in public domains, we will lodge a police report for action to be taken under the existing civil laws such as the Sedition Act,” he said yesterday.
He was responding to reports over the religious authorities’ move to bar four Muslim women finalists from participating in the Miss Malaysia-World pageant scheduled on Aug 2.

Sihir: Usaha Nista Syaitan Kepada Manusia

Keperluan Mewujudkan Undang-Undang Banteras Sihir
SIHIR ialah suatu ilmu dipelopori syaitan kepada manusia yang bakal mengundang kemudaratan sama ada kepada pengamalnya atau mangsanya.
Pendapat tokoh mengenai sihir:
– Ibnu Khaldun – ilmu untuk menghasilkan kesan negatif ke atas mangsa dengan menggunakan anasir-anasir jahat daripada kekuatan kuasa ghaib (makhluk halus) atau sebagainya bagi tujuan jahat secara tersembunyi.
– Datuk Dr. Haron Din – suatu ilmu tersembunyi yang memerlukan kemahiran khusus menerusi konsentrasi amalan kebatinan secara berdamping dengan makhluk halus bertujuan mendapatkan kekuatan batin, sekali gus membolehkan pengamalnya menghasilkan perkara luar biasa, mencarik adat, memukau dan mangsa mematuhi apa sahaja kehendaknya dengan terpaksa.
– Wahid Abdul Salam Bali – permuafakatan, persetujuan antara ahli sihir dan syaitan untuk bersama-sama melakukan sesuatu yang diharamkan Allah bagi memudaratkan mangsa menerusi amalan-amalan syirik kepada Allah serta menunaikan apa sahaja permintaan ke atas ahli sihir itu.
Menyedari kepentingan isu ini, Persatuan Peguam-Peguam Muslim Malaysia (PPMM) dengan kerjasama Kelab Peguam Muda Malaysia Mesir (KPMM) baru-baru ini menganjurkan seminar bertajuk, ‘Diagnosis Sihir: Di mana penghujungnya’ di Kaherah, Mesir yang dihadiri mahasiswa jurusan syariah, usuluddin, perubatan, bahasa dan jurusan-jurusan lain.
Pelbagai isu berkaitan sihir dikupas, antaranya oleh:
– Penceramah dari Persatuan Kebajikan dan Pengubatan Islam Darussyifa, Ikmal Zaidi Hashim.
– Penulis sendiri, barisan kepimpinan PPMM iaitu Timbalan Presiden, Naib Presiden, Setiausaha Agung; Abdul Rahim Sinwan, Marlina Amir Hamzah dan Ridha Abdah Subri.
– Antara exco PPMM lain yang membantu melancarkan seminar ini ialah Siti Razasah Abd. Razak, Yusmawati Ab. Llah, Abdul Halim Bahari dan Zainal Abidin Shaik Zakaria. Wakil PPMM dari Johor, Noor Azlina Muhd. Noor juga turut membentang kertas kerja beliau.
– Seminar ini menjadi lebih menarik dengan kehadiran beberapa hakim syarie iaitu Datuk Abdul Walid Abu Hassan (Ketua Hakim Syarie Pulau Pinang), Datuk Abdul Rahman Md. Yunos (Ketua Hakim Syarie Pahang) dan Muhammad Azhari Abd. Rahman (Hakim Mahkamah Tinggi Syariah Pahang).
– Dua orang wakil Kelab Peguam Muda Jordan (KPMJ), Putera Muhammad Mu’izz Mahayuddin dan Mohd. Hafizuddin Shah Abd Latip juga turut hadir.
KEPERLUAN MEWUJUDKAN UNDANG-UNDANG BANTERAS SIHIR
Undang-undang membanteras amalan sihir perlu diwujudkan, tidak hanya perlu dilihat dari kaca mata undang-undang jenayah sahaja tetapi hendaklah juga terpakai kepada undang-undang lain sama ada sivil atau syariah.
Ini kerana sihir juga berlaku dalam hal ehwal kekeluargaan, perniagaan dan persahabatan. Sihir bukan sahaja melibatkan orang Islam tetapi orang bukan Islam juga ramai yang mengamalkannya.
Oleh demikian, sekiranya perkara mengenai sihir ini diletakkan di bawah ruang lingkup mahkamah syariah sahaja sudah tentu aspek utama undang-undang yang ingin diperkenal tidak kesampaian kerana orang bukan Islam bakal terlepas daripada kawalan undang-undang tersebut. Ia haruslah mencakupi mahkamah syariah dan sivil, sekali gus memberi keadilan kepada masyarakat bukan Islam.
Bagaimanapun, saya berpandangan pembuktian adalah masalah paling utama bagi mensabitkan kesalahan mengamalkan sihir ini. Ini kerana ia menggunakan makhluk halus yang tidak dapat dilihat oleh mata kasar.
Kesukarannya berlaku pada dua peringkat, sekali gus mendatangkan kesukaran bagi membuktikannya di mahkamah:
1. Bagi membuktikan amalan itu adalah sebenarnya sihir.
2. Bagi membuktikan individu khusus yang mengamalkan sihir dan terkena kepada mangsa tertentu.
ALTERNATIF TERBAIK
Pihak berkuasa perlu menubuhkan satu badan khas dianggotai barisan pakar-pakar yang mempunyai kredibiliti tinggi termasuklah dalam kalangan ulama. Mereka ini perlu disaring dan dipastikan benar-benar mempunyai kepakaran dalam bidang berkenaan. Panel ini diberi tanggungjawab untuk memperaku tentang amalan sihir dan kesannya.
Perakuan dan asas-asasnya hendaklah dibawa ke mahkamah dan diterima oleh mahkamah sebagai keterangan yang konklusif. Dengan cara demikian, pakar-pakar ini tidak disoal balas di mahkamah dan tidak tertakluk kepada prosedur rumit pembuktian di mahkamah. Sehubungan itu, mereka akan dapat membantu mahkamah membuat keputusan yang tepat.
Menurut Haron, ilmu sihir yang dikatakan telah muncul sejak zaman Nabi Idris a.s. lagi bukan sahaja diharamkan dalam Islam malah agama lain seperti Yahudi dan Nasrani juga melarang amalan berkenaan.
Sihir sebenarnya wujud dalam mana-mana masyarakat sama ada yang maju atau mundur. Ahli-ahli sihir mengambil kesempatan daripada amalan mereka untuk faedah keduniaan tanpa menghiraukan nilai-nilai murni kehidupan sejagat.
Jabatan Peguam Negara disyorkan agar menubuhkan satu jawatankuasa khas dianggotai ulama dan pakar perundangan Islam yang mahir dalam perkara melawan sihir ini disertai pakar perubatan moden dan Islam serta penggubal undang-undang bagi menyediakan draf undang-undang berkaitan.
Ia seboleh-bolehnya tidak hanya tertumpu kepada sihir sebagai suatu kesalahan jenayah tetapi juga aspek pembuktian, hal ehwal berkaitan kekeluargaan dan juga perniagaan.
Dengan cara ini, undang-undang bakal digubal itu akan menjadi undang-undang komprehensif dan dinamik yang boleh menyekat amalan khurafat dan syirik seperti sihir. Walaupun ia nampak sukar dilaksanakan tetapi sebenarnya terdapat ruang-ruang yang boleh dimanfaatkan dari sudut undang-undang, prosedur dan keterangan bagi melaksanakan kawalan terhadap fenomena sihir ini.
